Welcome to BALTACI. The terms “we”, “us” and “our” refer to BALTACI.
BALTACI operates this website and online store, including all related information, content, features, tools, products and services provided to customers (collectively, the “Services”). Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to offer the Services.
These Terms of Service, together with the policies referenced herein, describe your rights and responsibilities when accessing or using the Services.

Nothing in these Terms limits or excludes any mandatory rights granted to consumers under applicable law.
SECTION 1 — ACCESS AND ACCOUNTS
You must have the legal capacity required under applicable law to use the Services and enter into a purchase agreement.
When creating an account or placing an order, you agree to provide accurate, current and complete information, including your contact, billing and delivery information.
You are responsible for keeping your account credentials secure and for activity performed through your account. You must notify us promptly if you believe your account has been accessed without authorization.
We reserve the right to suspend or terminate accounts that are used unlawfully, fraudulently or in violation of these Terms.
SECTION 2 — PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to display our products, colours, materials, measurements and details as accurately as possible. However, colours and appearance may vary depending on your device, screen settings, lighting and photography.
Minor variations resulting from handcrafted production, fabric characteristics or finishing techniques are not necessarily considered defects.
Product descriptions, prices and availability may be updated without prior notice. We reserve the right to discontinue products or limit available quantities.
Nothing in this section affects your legal rights concerning products that are defective, damaged, incorrectly supplied or not as described.
SECTION 3 — MADE-TO-ORDER AND CUSTOM-SIZE PRODUCTS
Some BALTACI products are produced after an order is placed. Estimated production periods are displayed on the relevant product page. Shipping time is additional to the production period.
Standard-size products and custom-size products are different order types.
A custom-size product is created according to measurements or individual specifications supplied by the customer. You are responsible for ensuring that the measurements and information submitted are accurate.
Once production of a custom-size product has started, changes or cancellations may not be possible.
Products created specifically according to a customer’s personal measurements or individual requirements may be excluded from the right of withdrawal where permitted by applicable law.
This exclusion does not affect your legal rights if a custom-size product is delivered incorrectly, damaged, defective or does not conform to the agreed specifications.
SECTION 4 — ORDERS
Placing an order constitutes an offer to purchase the selected products.
After receiving your order, we may send an order acknowledgement. This acknowledgement does not necessarily mean that the order has been accepted.
An order is accepted when we confirm acceptance or begin processing the order. We reserve the right to reject or cancel an order where reasonably necessary, including in cases of product unavailability, incorrect pricing, suspected fraud, payment failure or inaccurate customer information.
If we cancel an order after payment has been received, the relevant payment will be refunded using the original payment method.
Please review your order, selected size, colour, delivery address and custom measurements carefully before completing your purchase.
Products purchased from our online store are intended for personal use and may not be purchased for unauthorized commercial resale.
SECTION 5 — PRICES AND PAYMENT
Product prices are displayed in the currency shown on the website.
Any applicable taxes, shipping charges or other costs will be displayed before the order is completed, in accordance with applicable law.
We may change product prices at any time. A price change will not affect an order that has already been accepted, except where an obvious pricing error has occurred and applicable law permits correction.
You agree to provide complete and accurate payment and billing information. You confirm that you are authorized to use the selected payment method.
Payments may be processed by Shopify or an authorized third-party payment provider. We do not directly store complete payment card details.
SECTION 6 — SHIPPING AND DELIVERY
BALTACI currently ships only to the destinations shown as available during checkout.
Delivery estimates are provided for guidance and may vary depending on production time, destination, order volume and courier operations.
We are not responsible for delays caused by circumstances outside our reasonable control. However, nothing in these Terms limits any mandatory rights you may have regarding delivery.
You are responsible for providing a complete and accurate delivery address and contact information. Additional costs resulting from incorrect or incomplete information may be charged where permitted by law.

SECTION 7 — RETURNS AND REFUNDS
Eligible standard-size products may be returned in accordance with applicable consumer law and our Refund Policy.
Custom-size or personalized products created according to the customer’s measurements or individual requirements may not be eligible for return due to a change of mind, where permitted by applicable law.
This does not affect your rights concerning products that are defective, damaged, incorrectly supplied or not as agreed.
Before returning a product, you must contact us and follow the return instructions provided by our client services team.

SECTION 8 — INTELLECTUAL PROPERTY
All content made available through the Services, including the BALTACI name, logos, product names, designs, photographs, videos, graphics, text, layouts and other materials, is owned by or licensed to BALTACI and is protected by applicable intellectual property laws.
The Services and their content may be used only for personal and non-commercial purposes.
You may not copy, reproduce, distribute, modify, publish, sell, license, commercially exploit or create derivative works from our content without prior written permission.
The Shopify name and related trademarks belong to Shopify or its respective owners.
SECTION 9 — ACCEPTABLE USE
You may use the Services only for lawful purposes.
You must not:
• use the Services for fraudulent, unlawful or malicious activities;
• infringe intellectual property, privacy or other legal rights;
• submit false or misleading information;
• upload viruses, harmful code or malicious content;
• attempt to access accounts, systems or data without authorization;
• interfere with the security or operation of the Services;
• scrape, copy or commercially exploit website content without authorization;
• impersonate another person or entity;

We may restrict or terminate access where we reasonably believe these Terms have been violated.

We are not responsible for the content, availability, security or practices of third-party services that we do not control.

SECTION 11 — SHOPIFY
Our online store is hosted by Shopify.
Purchases made through this store are made directly between you and BALTACI. Shopify provides the e-commerce technology but is not the seller of BALTACI products.
Shopify may process certain information as necessary to operate and improve its platform. Further information is provided in our Privacy Policy and Shopify’s applicable privacy documentation.
SECTION 12 — PRIVACY

SECTION 13 — FEEDBACK AND REVIEWS
If you submit a review, comment, image, suggestion or other feedback, you confirm that you have the right to provide that content and that it does not violate any law or third-party right.
You grant BALTACI a non-exclusive, worldwide, royalty-free right to use, reproduce and display submitted feedback for operating, improving and promoting the Services, subject to applicable law.
We may remove feedback that is unlawful, fraudulent, abusive, misleading, offensive or infringes the rights of others.
SECTION 14 — ERRORS AND AVAILABILITY
Occasionally, the Services may contain errors relating to product descriptions, prices, promotions, shipping costs, delivery estimates or availability.
We reserve the right to correct errors and update information. If an error materially affects an order you have already placed, we will contact you and take the action required under applicable law.
SECTION 15 — SERVICE AVAILABILITY
We aim to keep the Services available and secure, but we cannot guarantee uninterrupted or error-free access at all times.
Maintenance, technical problems, internet failures or circumstances outside our reasonable control may temporarily affect availability.
We may update, suspend or discontinue parts of the Services where reasonably necessary.
SECTION 16 — LIABILITY
Nothing in these Terms excludes or limits liability that cannot legally be excluded, including mandatory consumer rights.
To the maximum extent permitted by applicable law, BALTACI will not be responsible for indirect or unforeseeable losses arising from the use of the Services.
We are not responsible for losses caused by circumstances outside our reasonable control.
Any limitation stated in these Terms applies only to the extent permitted by applicable law.
SECTION 17 — TERMINATION
You may stop using the Services at any time.
We may suspend or terminate access if you violate these Terms, use the Services unlawfully or create a security or fraud risk.
Termination does not affect rights, obligations or payments that arose before termination.
Provisions concerning intellectual property, liability, privacy and dispute resolution will continue to apply where appropriate.
SECTION 18 — SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be applied to the maximum extent permitted or removed where necessary.
The remaining provisions will continue in effect.
SECTION 19 — GOVERNING LAW AND DISPUTES
These Terms and purchases made through the Services are governed by the laws of the Republic of Türkiye, without limiting any mandatory consumer protection rights that apply to you.
Consumers may apply to the competent Consumer Arbitration Committee, Consumer Court or other legally authorized authority in accordance with applicable law.
Before starting formal proceedings, you may contact us so that we can attempt to resolve the matter directly.

We may update these Terms to reflect changes to the Services, our business practices or applicable legal requirements.
